This policy outlines what data We Can Talk collects on our website and online learning management system (LMS), how we use and store your information, and your rights regarding your data. We take a proactive approach to user privacy and ensure the necessary steps are taken to protect user privacy in compliance with the UK General Data Protection Regulation (UK GDPR).

  1. What Information We Collect

We collect different types of personal data depending on how you engage with us.

For Learners (registered via their organisation’s unique link):

  • Name – Used to set up your learning account. Stored securely on UK-based servers.
  • Email Address – Used to set up your account and communicate with you regarding your training.
  • Organisation – Provided by your organisation as part of the registration process.
  • Demographic Data – Such as job role and location to evaluate training effectiveness.
  • Pre, Post, and Follow-Up Survey Responses – Stored securely on UK-based servers and used for impact assessment.

For Individuals Signing Up for Marketing and Promotional Emails:

  • Name
  • Email Address
  • Job Role (if provided on the sign-up form)
  • Organisation (if provided on the sign-up form)
  • Other (if provided on the sign-up form)

The data collected will depend on the fields included in the specific sign-up form you complete.

  1. How We Use Your Data

We process your personal data to:

  • Create and manage your learning account.
  • Provide access to courses.
  • Send essential training-related emails (login details, reminders, certification links, additional included training).
  • Generate aggregated, anonymised reports to measure learning impact.

We only share data from people who have signed up via their organisation (subscribing organisations).

We distinguish between two groups for email communications:

  1. Users from subscribing organisations – You will receive course-related emails as part of your organisation’s subscription.
  2. Users who signed up for marketing emails – You will receive promotional emails only if you opted in. You can unsubscribe at any time.
  1. Legal Basis for Processing Your Information

We rely on the following legal bases:

  • Performance of a Contract – For users from subscribing organisations, as training and related emails are part of the service.
  • Legitimate Interest – To improve training impact and track compliance.
  • Consent – For users who sign up for marketing emails.
  1. How We Share Your Data

We share certain information with your subscribing organisation to track training completion. This includes:

  • Name
  • Email Address
  • Course Completion Status (started/completed, date of completion)

We do not share individual responses to course questions with your organisation, only aggregated anonymised data.

  1. Retention & Deletion Policy

For users from subscribing organisations, we retain your learner profile (name, email, organisation, and course history) for up to 3 years after your organisation’s subscription ends. You will not have access to your account if your organisation is not subscribed. If your organisation does not resubscribe during this period, your data will be deleted unless required for legal or compliance reasons.

We retain fully anonymised impact data indefinitely for research and reporting. This data contains no personal identifiers and cannot be linked to any individual.

We use Mailchimp to manage and send emails to both learners (as part of their organisation’s training access) and individuals who have signed up to receive marketing or support-related communications (such as news, events, or customer support). We also use Google Mail (Gmail) for direct communication, including responses to support enquiries.

Mailchimp processes personal data (such as name and email address) on our behalf in accordance with their own privacy practices. Mailchimp is based in the United States and certified under the Data Privacy Framework, which ensures an adequate level of data protection for international transfers under UK GDPR.
